Monsieur le Ministre, <\/span><\/h4>\n

Jeudi dernier, une femme a \u00e9t\u00e9 victime d\u2019une tentative de f\u00e9minicide dans un train par son ex-compagnon. Harcel\u00e9e depuis des mois, elle avait port\u00e9 plainte \u00e0 plusieurs reprises mais pourtant, rien n\u2019avait \u00e9t\u00e9 fait pour la prot\u00e9ger. <\/span><\/p>\n

Pourriez-vous m\u2019indiquer, monsieur le ministre, quelle est la politique du parquet concern\u00e9 en la mati\u00e8re? A-t-il suivi les recommandations de la COL 4\/2006\u00a0qui pr\u00e9conise la d\u00e9signation d\u2019un magistrat de r\u00e9f\u00e9rence\u00a0? Les magistrats ont-ils re\u00e7u une formation sp\u00e9cifique\u00a0? <\/span><\/p>\n

<\/a> Disposez-vous d\u2019informations concernant le traitement des plaintes introduites par la victime\u00a0? Ont-elles \u00e9t\u00e9 class\u00e9es sans suite\u00a0? Si oui pour quelle raison\u00a0? Une analyse de risque\u00a0a-t-elle \u00e9t\u00e9 r\u00e9alis\u00e9e\u00a0? Pourquoi une interdiction d\u2019entrer en contact avec la victime (pr\u00e9vue par la loi de janvier 2003) n\u2019a pas \u00e9t\u00e9 mise en place\u00a0? <\/span><\/p>\n

En d\u00e9cembre dernier, je vous interrogeais d\u00e9j\u00e0 sur la question du suivi des plaintes pour harc\u00e8lement. Vous m\u2019indiquiez que le r\u00e9seau d\u2019expertise \u201cCriminalit\u00e9<\/span> contre les personnes\u201d travaille actuellement sur un outil d\u2019\u00e9valuation du risque qui vise \u00e0 tenter de rep\u00e9rer les situations les plus \u00e0 risque d\u2019un passage \u00e0 l\u2019acte majeur de type homicide. Pourriez-vous m\u2019indiquer o\u00f9 en est ce projet\u00a0? <\/span><\/p>\n

R\u00e9ponse du Ministre Geens (Commission Justice du 19\/02\/2020)<\/h4>\n

Madame la pr\u00e9sidente, Madame Schlitz<\/span>, je ne peux r\u00e9pondre \u00e0 vos questions relatives \u00e0 un cas individuel car l’enqu\u00eate est en cours.<\/p>\n

Il existe bien un magistrat de r\u00e9f\u00e9rence au sein de chaque arrondissement et un policier de r\u00e9f\u00e9rence au sein de chaque zone de police. Outre la formation de base destin\u00e9e \u00e0 tous les magistrats, les magistrats de r\u00e9f\u00e9rence ont b\u00e9n\u00e9fici\u00e9 d’une formation sp\u00e9cifique relative \u00e0 l’approche \u00e0 adopter face \u00e0 des situations de violence entre partenaires. Il reste cependant tr\u00e8s important d’assurer un niveau de formation et de sensibilisation pour tous les policiers et les magistrats amen\u00e9s \u00e0 intervenir en cette mati\u00e8re puisque ce type de situations se pr\u00e9sente \u00e0 toute heure du jour et de la nuit. Ce n’est donc pas toujours le policier ou le magistrat de r\u00e9f\u00e9rence sp\u00e9cialis\u00e9 qui intervient dans l’urgence. Mon administration pr\u00e9pare actuellement un texte l\u00e9gislatif qui introduit une obligation de formation permanente. Celle-ci inclura le th\u00e8me de la violence sexuelle et sera obligatoire pour tous les magistrats traitant ce genre d’affaires.<\/p>\n

Concernant l’outil d’\u00e9valuation du risque, la coordonnatrice du r\u00e9seau d’expertise “Criminalit\u00e9 contre les personnes” m’a inform\u00e9 qu’il \u00e9tait en voie de finalisation. Il sera int\u00e9gr\u00e9 dans une circulaire dont le projet sera soumis au r\u00e9seau d’expertise en avril prochain. Pour de plus amples informations, je vous renvoie \u00e0 l’expos\u00e9 du procureur g\u00e9n\u00e9ral et de la coordinatrice du r\u00e9seau d’expertise, donn\u00e9 le 20 novembre 2019 lors de l’audition en commission de la Justice.<\/p>\n

Monsieur le ministre, je vous remercie pour votre r\u00e9ponse. Je m’attendais en effet \u00e0 ce que vous ne r\u00e9pondiez pas sur le cas individuel m\u00eame s’il me para\u00eet embl\u00e9matique d’un r\u00e9el probl\u00e8me en Belgique. Vous me parlez d’un projet de loi relatif \u00e0 la question des violences sexuelles. Je trouve qu’il y a un vrai souci dans ce d\u00e9bat en ce que sur la question du f\u00e9minicide, lors d’un r\u00e9cent colloque, votre coll\u00e8gue, MmeMuylle, est venue s’exprimer devant l’assembl\u00e9e en confondant les questions de violences sexuelles, de harc\u00e8lement et de f\u00e9minicide. Je veux bien qu’il y ait un lien car tout est li\u00e9 mais je pense que ce sont des probl\u00e8mes sp\u00e9cifiques qui attendent des r\u00e9ponses sp\u00e9cifiques. Ne m\u00e9langeons pas tout! Je relirai le document auquel vous faites r\u00e9f\u00e9rence mais j’ai, par ailleurs, assist\u00e9 \u00e0 la pr\u00e9sentation de M.deValkeneer \u00e0 la Chambre, vendredi dernier, lors du colloque du Vrouwenraad, qui \u00e9tait \u00e9clairant quant aux lacunes de la justice en la mati\u00e8re.<\/p>\n
